Our country’s servicemembers make extreme sacrifices to protect our freedom. In training and in the field, they are subject to deafening gunfire, explosions, and other noise that requires adequate hearing protection. Our clients allege that 3M sold defective Combat Arms Earplugs to the military and failed to provide adequate warnings related to their use. As a result, more than 250,000 servicemembers and veterans have brought claims against 3M, alleging life-altering hearing damage and irreversible hearing-related injuries.

As early as 2001, Aearo Technologies began selling the Combat Arms Earplugs to the military, at one point being awarded an exclusive contract. 3M later acquired Aearo and took over the manufacturing. During testing, Aearo discovered a design flaw that made the earplugs defective and unable to be properly inserted into the ear canal. Instead of correcting the flaw, 3M and Aearo manipulated testing to hide the defect to gain approval for sale and use. The faulty earplugs were heavily used both domestically and abroad between 2003 to 2015.

Trials in the 3M Combat Arms Earplugs MDL began in the spring of 2021 in the U.S. District Court for the Northern District of Florida. Numerous trials have resulted in verdicts for plaintiffs. The 3M litigation is now the largest MDL in history. We at Keller Postman are working diligently to secure recoveries for our servicemember clients.
