Florida Files First-in-the-Nation Lawsuit Against OpenAI and Sam Altman for Deceiving Families About ChatGPT | Keller Postman Serves as Outside Counsel

Chicago, IL, 6/1/2026 – Keller Postman is serving as outside counsel to the State of Florida in its lawsuit filed in the Tenth Judicial Circuit of Florida against OpenAI and CEO Sam Altman, alleging that the company has deceived users about the risks posed by ChatGPT, especially to children. Attorney General James Uthmeier filed the action, which accuses OpenAI of marketing its product as safe and trustworthy while ignoring well-documented harms.

The State’s complaint alleges that ChatGPT is designed in ways that foster addictive behavior and cognitive harm, mimicking empathy and human characteristics to encourage users to share more information and engage more deeply with the platform. Unlike static content available elsewhere on the internet, ChatGPT actively generates, promotes, and facilitates user tasks in real time, including tasks involving self-harm or violence.

Central to the State’s allegations is OpenAI’s approach to parental oversight. The complaint contends that parental controls are not required for children to access ChatGPT, and that OpenAI has explicitly marketed the ability to keep children’s conversations hidden from parents, with no mechanism for parents to request access. The complaint further alleges that ChatGPT collects data from minors without meaningful parental oversight. Despite research and repeated warnings from experts both inside and outside the company, OpenAI has continued to market ChatGPT as safe and reliable.

Florida law prohibits unfair and deceptive trade practices. The complaint alleges that OpenAI’s conduct causes ongoing harm to Floridians, and the State seeks damages on behalf of the people of Florida and an end to the deceptive and dangerous practices outlined in the complaint.

“OpenAI and Altman ignored internal and external safety warnings, put children at great risk, and allowed a dangerous product to reach millions of Floridians,” said Attorney General Uthmeier.
